That lawsuit is a claim for fraud, and that’s what fraud typically is...a misunderstanding and someone being “injured” and wanting to hold the other responsible for it.

I have a rhetorical question to try to spark some empathy: If you had been in a car accident that was your fault, totaled your car, injured yourself to the point of not being able to do your job, and injured another party that was going to sue you/your insurance company, should you and your kids have been left to just suffer the consequences?
