There are passive conservative real estate investments that qualify for a 1031 exchange and return in the same range plus quite a bit more when you factor in all of the Internal Rate of Return components.I always counsel folks to keep their equity and real estate investments separate. 

When I used to self manage my properties I used MySmartMove and felt it was a very good screening process - it checks all the main things you need to check (criminal history, bankruptcy/foreclosure history, credit, etc).

Some of the orgs have silly, or poorly thought out internal processes that lead to issues like this.Not a good sign, as several have mentioned.Recommend getting to the bottom of it or replacing them.

In fact, they should be reported to the authorities for what I consider criminal behavior and at minimum for bait and switch practices and failure to properly disclose.

@Thomas Rutkowski, Section 453 of the Internal Revenue Code has been around for years, as you state, but the case that specifically supports the Monetized Installment Sale is a relatively recent case.
