2016 there are new asset allocation rules for installment sales and options, the depreciation over the 20 years goes to the new buyer, Greg gets to pay taxes on his installment sale even if he doesn't receive principal, you don't defer taxes for 20 years.

If the LLC is a sole proprietorship (also called a disregarded entity) of if you own the property in your own name, the portion of the mortgage interest allocated to the residential unit is deducted on Schedule A (if you itemize).

I called my accountant right away when I found this out and he stated it had to be done that way because of new program or something the irs is using, taxes would not allocate properly or something.

This is commercial, lease payments or earnest money can reduce the sale price, it is not subject to Dodd Frank and the end loan is seller financed, no issue with allocating rents toward the purchase price in THIS transaction.I wouldn't mess with an option for less than a year, I'd go straight to the purchase contract with possession prior to closing under a master lease .

You can only allocate a couple % for this - the other regularly recurring expenses like roto rooting, regular tree trimming, asphalt sealing, etc can all be allocated as part of your diligence and be pretty firm year over year.
