I continue to charge the tenants until I have possession, which includes keys.What you could do if you choose to and which is probably better in your case is to complete the walk through and then let them leave.

Not to hijack this thread, but I wanted to ask how a deed in lieu of foreclosure would work in a non judicial state.If borrower agreed to this would the lender be able to get possession of the property back quicker than a mortgage that did not have this provision?

Hi I am a newbie but a Quick Claim Deed contains no title covenant and thus offers the grantee no warranty as to the status of the property title; the grantee is entitled only to whatever interest the grantor actually possesses at the time the transfer occurs.This means that the grantor does not guarantee that he or she actually owns any interest in the property at the time of the transfer, or if he or she does own an interest, that the title is free and clear.

Make sure you have the tenants sign the proper legal documents turning over possession of the unit to you and that they hand you the keys before you give them the cash!

Never heard of itits a form of ownership rights.you buy a property from someone and you deed them a life estate.. they live there for the rest of their life once they pass they no longer have the right to the property and you then take over possession.. it is common for those getting on in years  and their heirs don't want them to have to move and it generally means no payments maybe only utls..

In this state (ohio) one has to file for a writ of possession (different from writ of detainer) with the foreclosure court case instead of a new civil eviction case.
