I would think so.Thinking out loud here though, even with a licensed agent/broker on board, could it not be interpreted that I was trying to circumvent RE law as I'm still brokering a deal/deals even though I or the LLC is a principal in the initial lease option transaction.It's an interesting option though, I'll give you that Brian.

If it were done this way, then my personal 'contribution' in setting the price of the insurance would have been a prohibited transaction (according to my interpretation of the IRS code and as interpreted by my IRA trust company (IRA Financial Group)).On the second part of your response, are you sure that I can rent a property owned by my SD-IRA back to myself?

Rent credit. 5.073(5) prohibits increasing the option price for requesting repairs. 5.083 states the purchaser can cancel the contract for improper platting…which…shouldn’t’ be an issue unless you cleared land with your John Deer…. 5.085 is the big mamma….it states the seller must have fee simple title…which some interpret as without a mortgage..this is not true…a fee simple title is the most basic, simple title.

You then have 60 days to put those funds back in the IRA or into a new IRA or other qualified retirement plan.The old interpretation was that you could do this one per 12 months per source account.The new restrictions limit you to one such transaction per 12 months, period.This does not impact your ability to move funds from one IRA or 401k to another on a direct, trustee-to-trustee basis.
