Thank you.If your friend can clear the intent bar and begin the 1031, I'm having a tough time seeing how he'll be able to structure it as one exchange unless he is selling the entirety to one investor.

You should also walk the property and assess if their is a lot of deferred maintenance, which would offer more evidence that the association is not healthy.2) You need to review the HOA bylaws in their entirety

Best of luck Thanks Jeremy, it is a small building, with only four owners, so as you can imagine, the HOA is basically the entirety of the owners.The HOA rules and bylaws stipulates that the common wall issues are not 100% HOA responsibility.
