It turns out the boyfriend has been charge with abusive behavior and has been issued a restraining order by the courts that essentially evicted from the home.Due to the fact they both did not strong credit, I had initially taken 2 months rent from them as security deposit, with the understanding that 1 month would be returned at end of 1st year lease if they decided to renew. 

Several owners have posted here on BP, that they made the mistake of paying the CFK funds to the nonpaying tenant, usually duped because that tenant claimed they needed the money to move, and then the tenant did NOT move out:(So, our CFK process requires them to sign acknowledgement forms about the process, which we've actually been able to use in court against the tenant when they don't follow thru on the process.SECURITY: always a challenge in Class C & D areas!

I would add, also check to see if you state has court cases on line.

This is all to show to a Court and a savvy plaintiff attorney (when you get sued) that your business activities follow corporate formalities and they are separate from you as an individual. 

Even if you get a solid PM I always like to double-check the county court records and see if anything was missed. 

You are terminating their lease, which is done without court involvement.I recommend you present the tenants with an introduction letter as soon as you close on the property.

They probably do crack down now and then and the consequences will probably be way more expensive when you are in the federal court system, than just a slap on the wrist or a finger wag.   

Also it would likely need a registered agent in state to properly handle a court process.

Meaning you will pay both sides attorneys fees as well as end up with other possible costs going forward in your life and possible court forced asset liquidations and kicked out of your home.

I need to respond to the attorney's demand letter and almost want to go to court, even if it takes six months to evict her.
