It may trigger if you are paying down the balance aggressively during the prepayment penalty period. 

So, your property must be secured with deterrents to hopefully stop this from happening - but, it's impossible to guarantee security.

@Ethan Borshansky, There was a brief period of time in the early 2000s when this type of "leasehold exchange" as described above was fairly common. 

The timing of people most apt to say "F-it, I'm done with this stuff, I'm gonna take the $ and run" is in that 90 day period. 

EVEN IF THEY ARE PAID they cant guarantee that a short sale will even be approved AND cant guarantee any price.

If I only need a small amount for a short period of time, a HELOC works great although rates are variable.

If the LLC is the maker on the note, there's a good chance you'll be required to personally guarantee the note.
