Perhaps I missed it and would love to see where in the bill it states that capital gains must be used. https://www.congress.gov/bill/115th-congress/house-bill/828/text#toc-H2CE36B67ACCC4F89BD0B2571450C0176The portion of an OZ fund interest attributable to any capital invested in excess of the qualified gain amount is not eligible for the OZ tax exemption.

Whether you owe 50% or 100% on a property makes no difference if you can not afford the payments.Also keep in mind when you have excessive equity in a property and the markets turn it is your own cash that is at risk not the banks money.

To get this, if I can get it, I'd be paying more than those combined debts/liens, so hopefully the only ball they'll play is settling up from the excess foreclosure funds.

Something that's not mentioned on this forum much though- watch out for midwestern markets that cash flow well w/ respect to price:rent ratio, but have an excess of rental housing supply relative to the tenant pool.
