But if the law suit will truly be settled in a year and if the home will truly be worth more in a year than its current value then it seems like renting is a no brainer.

I’m wondering...(1) If the association decides to implement a no renters policy and I already have the tenants in the unit, am I protected under a ‘grandfather’ situation, or could they force my tenants out?

As for the deposit, if he has really fixed the house in the last 10 years, then this is a no-brainer, give him back.
