I like one of our attorneys viewpoint (from our REI) who owns lots of property, He holds properties that have mortgages in his own name and holds larger properties where he has partners in an LLC.

They (HOA manager, HOA president, and HOA attorney) inform me that there's a super lien on the property and that I have to pay it.Of course I pulled an O&E before purchase and there was only the mortgage lien (foreclosing lien) on the property.

I would think an ESA animal wouldn't be exempt from protocols regarding disturbing neighbors etc but I would check with an attorney to be sure.
