One can be just an agent or an agent that has joined NAR and is also a Realtor.

Realtor.com sources from MLSes nationwide as both the MLSes and Realtor are part of NAR. 

From what I read the NAR of Alabama and Georgia have been fighting this.

You are a representative of the broker and brokerage you work for and a representative of NAR.

If they don't respond to binder refund requests for over 30 days I'm sure the lawyer will be on board for a complaint to the NAR's complaints board, which will probably send the case to arbitration.
