Here are the details of my situation:- I purchased my first SFR / primary residence in October 2018 (~7months ago) with a 3% downpayment conventional loan with the agreement I would live in the property for 12 months- It seems getting a new low-downpayment loan will be difficult/impossible from a lender due to not fulfilling the 12 month duration in my current residence- the seller owns the triplex free and clear (paid cash for it 17 years ago) - the seller wants out bad.

If you acquire a property with any existing lease, voucher or not, you have to honor the terms...you're assuming the continuation of the agreement the prior owner entered into upon acquisition of the new property...you don't have a choice to not participate for the duration of the lease if you want paid.

so in our state.. the lease trumps the foreclosure as long as its arms length and basically at market.however if your going to move into the home you can evict right away.. if not as long as the tenant honors the lease they are allowed to stay there for the duration and at the rate on the lease..but some folks did bad things by singing 5 year leases at half of market rate to their buddies or relatives those got over turned.. but it cost money.we rarely anymore bid on occupied homes in any state that has tough evictions.

The CORefi will basically drain your equity up to 75% LTV on the property and you’ll be stuck paying that higher mortgage payment for the duration of your ownership.
