So a double whammy.Also remember retirement accounts are sheltered in case of bankruptcy, whereas if you put the money into real estate, generally that is not sheltered.So just a few thoughts...but again, it's really a question for your financial advisor.  

The buyer also can be harmed if the seller goes into bankruptcy and the loan is still in their name..

Student loans are not legally discharged in a bankruptcy proceeding but a mortgage is, so the bank loses that way.   

If they are alive then yes they would either sell it or more than likely they want to keep it and will file bankruptcy the day before.

If you sue a small local builder with no money, then you probably just force them into bankruptcy, they open the next week under a different name and continue on.   

Hopefully not to the point of them filing bankruptcy, but they will come around eventually or give up.
