Its a civil matter in that you've violated one of the provisions of the contract with the lender.Now, I am curious how a lease option would be structured in the case where you had a mortgage on the property.

Search on Hawaii State Judiciary...from the home page you can access necessary court forms, and do a criminal, civil, or traffic records search on locals.

People who do so without a license are breaking the law and it can be a criminal or civil violation.

If someone knowingly (or unknowingly) fails to notify the lender they are setting themself up for potential litigation.

Incidentally, I've been involved in a consumer litigation before.  

He violated the code, at least in the Commission's opinion, and was assessed a civil penalty.The first link Ohio Realtor posted has the text of these regulations.
