While I manage 65 or so units and we allow the owners to make that decision, I also own quite a few units myself. 

This allows me to make a full decision knowing the nature of the repairs, cost of repairs and have the ability to back out of my offer if there is a red flag or major foundation problem that increases my repair costs dramatically higher than I anticipated.

With the current market been short on single family homes in our area we have made a strategic decision to pivot back to flipping a few properties. 

This is better than not speaking with your aunt, letting the problem linger and likely worsen.From my experience, in New York, the ultimate decision will depend on many factors and Liberal judges (as told to me by others with way more experience in these matters) can rule in favor of someone with a sob story. i.e.

You still make some decisions, can exit again at will again using the 1031 rather than being tied up for 7-10. 

Every goal, decision, expectation, vision and operational decision has to be lock step with each other- and that isn't even discussing the money side of the agreement.
