I'm not sure why one would choose to make an (active) investment that is break-even, when there are other (passive) opportunities for RE ownership that can produce cash flows - i.e. private equity/syndications.

You can use HML don't get me wrong but if you just put a little bit effort in to pre-planning and getting all your ducks in a row then going with a traditional community bank would be a better option not only for your current new construction needs but also for future acquisitions.

If you fail to leave, you are simply evicting them as a holdover tenant which is cookie cutter and their lease violations aren't part of the eviction at all.
