Recently received my first K-1 from an SD-IRA syndication investment where I am considered a Limited Partner in a multifamily property in NC.It shows a negative amount per the depreciation taken against a relatively small amount of distributions, given at 6%.My CPA has said that the 990-T is not required at this juncture since there is no tax due.My other recent research has shown that a 990T should be filed every year as to accrue any losses to offset future gains.Have to assume this is a common scenario.

It potentially could be outside statute of limitations and most likely is upside down  SOL on a DOT in GA is 21 years.Also, i do not believe you would be able to collect/demand accrued interest for the last 8 years, unless the customer is still being billed.

In this case negotiate who will make payment in mean time.Free and Clear Example:Asking price is 100kARV is 200kRepairs 40kDebt is 0How to buy:Go get 1st for 40k from private lender (get this to accrue/no payments).Give seller a 2nd for 100k plus 50% of net proceeds of sale.At close the 40k goes to 1st...100k goes to seller...and if there was not cc or interest then 60k is split between you and seller.You make 30k.
