If it's as good an asset as you describe it to be I'd be keen to refinance with relatively low leverage and redeploy the cash without tax penalties if there are other opportunities out there for you.

The property sold a few days later, and I am not sure the new buyer knew what they were getting into, I have a pair of pretty keen eyes and can usually walk the property and see issues other might miss.But I couldn't believe at the time for FNMA to make it so clear they didn't want to know.

I did this back in 2009 and didn't sleep well for two years knowing the IRS wasn't too keen on many of the ROBS providers and the way they were using a loophole to avoid taxes on non-retirement income (they're the ones that coined the phrase "ROBS")...I was so concerned with my decision to pursue a ROBS that I voluntarily paid to have the IRS audit me (and provide a letter that said I was legally compliant) so I wouldn't have to worry about them eventually cracking down and unexpectedly being audited 5 or 10 years from now when things were less favorable.

The key thing is that I have no intention of selling the end product if anything I would be keen to purchase the remaining part of the development on completion as I am a buy and hold person.Thank you in advance for any guidance as I am pretty exited about the idea of doing my first ground up development.

I agree that there are probably many wholesalers out there that would not be too keen on having a lawyer review their contracts but I want to make sure everything is legit.
