If you don't have damages clauses, fraud or lying on application, requirements for millions in liability insurance... you can't enforce.

If the owner treats the park like their own personal ATM, never does maintenance, rents to anyone, then the park with quickly gain that reputation with residents & neighbors and the local law enforcement. 

Since this is a "housing" issue, the HOA absolutely IS required to adhere to Federal and State Fair Housing laws in the application and enforcement of all rules.

They Could file a suit to enforce the contract, make you proceed with the sale….but that is unlikely due to the time and costs it take.  

It is part of the landlord's job to make and enforce the rules. 

They also got rid of drug court diversion and they don't enforce trespassing laws.

I am not worried on my end, but I understand the sellers concern, and I just want to find a solution that will legally enforce me to hold up my end of the agreement, and have it structured in the event that I didn’t, the seller can get the property back ASAP.

I would like to enforce the contract and have tenant pay.

As the city works to try and figure out how to interpret and enforce these rules, I want everyone to be aware of some of the information out there right now.

My take on it - I think the code enforcement is driven by hotels, which St Pete by and large does not have (yet).
