Railroads are VERY difficult to negotiate with.U can look for some sort of prescriptive right away and sue for it but those don't usually work and litigation can run into the many thousands.If the owner contract works and you dont have to put much money down and you can remain positive cash flow and no personal guarantee on the note.. then even if you cant get a legal right of way its ok to own it forever type of thing.. just know selling it will be next to impossible unless you do the same thing for the next buyer.

That is a very big pill to swallow and not something I would want to be on the hook for.Also what if they file bankruptcy and get protection, you are stuck then with most likely not collecting rent for months and chances of collecting it in a judgment are not great.As others mentioned, there are many reasons, but best to wait.

May to August are the massive income generators then you should be willing to open your property to longer term snowbirds (retirees north of the Mason-Dixon Line); it’s not prescriptive but a proven technique.
