I would hate to file the detainer warrant and get a court date and the judge tells me I have to start the process all over again because my tenant didn’t sign the eviction notice. 

It’s a required precursor to an Unlawful Detainer (eviction) lawsuit and what you’ll need to go through if the tenant still doesn’t pay up by the end of the 3 days. 

@John Clark - we asked the police - they wont get involved until we have a forcible entry detaIner as we have no proof she’s a danger.

When those expire we will be filing a forcible entry and detainer.

Hi John,Late fees are still enforceable - you just cannot evict on them or get a judgement through an Unlawful Detainer beyond the worthless $75.

If you win the auction, personally, I'd hire an eviction attorney for an unlawful detainer action and be done with it.

Once I filed for an unlawful detainer, it's never held up in court.
