Given these circumstances, I believe there may be grounds for a class action lawsuit against these companies, and their owners.

At least with FHA 203(k), you cannot do ground up construction.

The time to get a large ground suppression there is extensive (it is ~45 minutes from a decent size town). 

Financing an ADU is more challenging than ground up construction.

That's close to break even for a short-term rental.To me, the worst thing you can be in Colorado is a middle-ground vacation rental.

My look is from the lens of a build to rent developer or ground up construction not existing inventory but again, there will always be a competitive advantage to it.
