A big part of my concern was that the air filter was located before the cavity. 

So you have the air grate to house, air filter behind grate, cavity for return (containing dust, bugs, spiderwebs), and then the gas heat unit. 

Wouldn't you want the airfilter to be as close as possible to the unit?

Are you answering yes to my first or second question?

Wouldn't it be more likely to suck things up within anything other than a properly sealed duct? 

Most of my research has indicated that this could be a code violation. I will have to further research CA code in relation to this.

Question about the air return: Should duct work always be used to make-up the air return from the homes interior wall to the gas furnace? Can framed in drywall be used?

@Naftali Tolibas thanks for the info. Not at this point and time. I would consider a flip if the numbers a right. I am aware of some homes that have been hacked in the UofA for rentals.
