So if they only lived there for a week or two, why wasn't your PM able to rent it for Sept or Oct?  As soon as they gave notice, their stuff should have been out of there (ie by the end of Aug as they only paid rent for Aug).  The fact that your PM is waiving a month's fees and marketing (which I'm guessing adds up to 1 month's rent) is not bad.  I'd focus on getting it rented ASAP.

Update: PM rented the unit in a span of 2 weeks after the left overs were hauled. Same rent and better tenant

Is is a shady area then it doesn’t matter how good the PM is you are going to constantly have these issues. Not much you can do, and going after a tenant who probably has no money will only cost you more money.


Yes it’s a C area and PM said it’s normal to accept credit and debit cards in this area

I wanted to ask how should I pursue this? My property manager said they will waive 1 month fees and marketing fees because of this but I am really pissed at the whole situation and am not sure how to handle this

You need to do 2 things: 
1) If you are 100% sure that they used a stolen credit card, you need to go to the police. You will probably need cooperation from the PM to find this out and get the information to make a report for fraud, and the police may not do anything beyond taking the police report, but if your original tenant was a scammer, they are going to scam again, and the police report with the scammer's name on it, even if it not prosecuted, will make it much more likely that the next time the scammer does it (and they WILL), they will be prosecuted. 

2. You need to start looking for a new PM.  Don't actually fire them until you have gotten any info etc. from your old PM that you need, and you have found a new PM that you have a properly vetted. You may also need to check your contract with the PM... really bad PM companies make it difficult to get out of their contracts (I wonder why... ).



Thanks @Jason Allen. I speak with the owner of PM and he seems to be good and provides me all details but I think it’s a lot of overhead for me to constantly nudge him.

I will review my contract and see if there’s a way out

Thanks@Ricardo R. really appreciate your response. I am new to being a landlord and this definitely makes me feel a little better and am using this as learning experience for future. Pursuing tenant in court I think is probably not worth the effort.
