Today is October 28, 2007 and we are in the same predicament! We found out this week that the lawyer never filed the 30 day eviction notice. If filed the deadbeats in our rental were scheduled to be out by the end of the month. Now there is no telling when or how we can get these people out. I want to go there and throw everything they own into the middle of the street but we live in CA and our rental is in NM. We own 2 houses there and have many appliances and other materials in our second home in hopes we would be able to fly there in Nov to start repairs. Plane tickets are paid for, we have people lined up to help out. I am so frustrated and have no idea what the next step should be. Originally we had a verbal agreement that we would give them 2 months and $1000 to move. They did not move! We got a lawyer and paid him to tie up loose ends with the deed and to evict them. This was at the end of Sept and he said he would issue eviction notice first of October. It is now the end of Oct which means this has been going on for 4 months and theres no end in sight. Do any of you have any advice??? We are desperate!!!!

(Deadbeats are my girlfriends aunts, thats the only reason we gave them the original 2 months and $1,000 to move)

We actually had a court hearing today and we filed the papers to have them evicted (30 Day). We had a lot of other issues with the property, thats the reason for the hearing. You don't usually get a court date to file a eviction notice. Everything went well and we are now proud owners of our second property. Thank you all for your comments!

The deed has been transferred. We own the house now. We are just unsure if we really need to give them a 30 day if they were never under a lease to start with. We gave them 60 days and cash to move because they are family but if we have to give them another 30 and eat anothers months rent I will truley be upset.

Has the deed been transferred and do you now own the house? If so, then you'll need to evict these people to get them out. If not, then I don't know how you will be able to get them out. The owner will need to do that.

Hello - my girlfriend and I recently took over a property owned by her now deceased
grandfather. Her grandfather passed away four years ago. There are two aunts that have
been living there rent free. We found out 3 months ago the house was going to be
foreclosed on beacuse the mortgage and property taxes have not been paid. We had a meeting
with the family and everyone agreed we should take over the home. We also agreed to give
the aunts 2 months to move out and gave them $1,000 to help make the move as easy as
possible. We brought all outstanding bills current on the home had a lawyer draw up papers
to have the property transferred. 2 months have passed, money all used up and they have
not packed up one box and don't plan on moving anytime soon. We have paid the mortgage
twice now. They never signed a lease with the grandfather and we do not want to keep them
on as tenants. Do we have the right to just kick them out? Some people have said that we
need to give them a 30 day notice but we already gave them 60 and money. We feel we are
being taken advantage of. What rights do we have in this situation?
