Financexaminer thank you, my sister moved out of state 2 yrs after I moved here to help her daughter and I know it sounds like booo hooo but I don't know anyone here, left all my friends and family back home.

I got a hold of a lawyer and suppose to call me back later. On the carport, I didn't know I was doing anything wrong since he wanted to buy it from me, my nephew who I'm buying the house from and his brother wanted it also but it was too big. I told him I'd pay him back for it but I actually in a way I see it when I gave him 16,500 for the house the carport was bought with that loan. So I didn't see anything wrong. and each month though not any where a large amount I have paid extra when I gave him the housepayment.....but I have proof that i had asked him several times for a contract. I tried to get a loan to buy the house but my credit was too low due to loosing the house and car in Indiana....They would not let me make the payments myself, i gave him a check, he'd cash it and pay the payments. I kind of wondered if he was allowed to sell it to me like that on contract cause it was like he didn't want the bank to know. well you think family wouldn't screw lyou but they will but according to him i'm screwing him. never again, i need the money out of this house so i can move back home and away from him,. thanks so much for your help.

I'm back again... .... first I don't have a contract on the house, but I have my cancel check where I paid off the second mortgage and numerous hate mail talking about the contract and all the family knows about it. 2 weeks ago I told him the university here talked to the 2 neighbors on one side of me and bought the house on the other side and that there is a very strong possibility that they will buy this, they are waiting for the funding. the house is only in his wife's name btw. but he called the university 2 weeks ago
and only talked to the secretary, but this week he sold his beloved corvette for 10,000 so he could get the loan and put it in his name and out of hers. I hadn't told him yet I had talked to the university and what they were going to do and let them know I was interested in selling but they would have to talk to my niece. I was buying the house on contract but it was in her name. Now it's my fault he lost sold his car but he knew 2 weeks ago, he is saying I have no right to talk to university. well with out the contract I guess I don't. But it affects me living here and all the money I put down on it. But he says I'm only going to get the 16,000 + I put down on it minus the 900 for the carport I sold. I thought I had a right to get rid of it as I figured I'm buying the house and had planned on living here maybe the rest of my life. it was in the way and a eye sore.
Do I have any say what so ever? I'll take him to court if I have to. I never heard of selling some one a house and the money going back to that seller.... In the mean time this week on top of it, I got sued by a credit card company and since I don't have this house in my name I am actually judgement free but if they sell this house and I get the money out of it will I have to use it to pay the credit card back. if I do I won't have much to be able to move back to Indiana let alone get another place to live. Some times, lots of times I just wish the Lord take me home I'm tired of all this. thank you

Well I'll see how it goes with the FHA loan. I guess putting all that money in it didn't mean nothing. If I had the money to start over I would leave and walk away from it, lest i'd have some peace. thanks for your help, I understand you can only tell me so much.

One thing I need to know is if

Can he order people off the property who I hire to fix something. I am seeing about some one to come in and paint the living room and fix the deck. he said if anyone he finds working on the house and he don't know about it he will order them off the property.

Jon? what do you mean by Yes, there's a risk of having the loans called due because you're triggering the "due on sale" clause ??


It had a balance of like say 30,000 with a 16, 125 second mortgage, if it was a loan attached to the house that is. They wouldn't tell me anything only I got the balance from him in front of the loan officer. He said it was for putting a new roof on, carpet, the carport (which so far i've heard 3 stories on what paid for that) and I really can't see that much going into this house. He had a 5000 shed which he took to the new house and I don't know if it was on it or not but I really didn't care cause I felt bad he wouldn't make anything on the house but he wouldn't anyways. I guess he thought some one was going to pay 45,000 for the house and pay off his 16,000 loan on top of it. the taxes said in 2006 it was worth 45,000 if I read it right.

Right now he has to give me a contract anyways to show what they sold me the house for and what I put in it and you know I'm such a nice christian person I would of had them add extra so I no longer had to hear "we didn't make any money off the house"" but not now.

I applied for a fha loan and even with my credit being low they are sure there is no reason for it to not go through. I might have to come up with some money anyways, I'm not sure.

Jon he would not let me have the book to make the payments I have to write the check out to him, he cashes it and pays the payment and I'm 100% sure he does do that. But the house is only in his wife's name and she filed bankrupty in march. I'm afraid they aren't telling me that it's true it's all clear now or not.

How can i find out if there are any liens on it. his brother did that to their own mom, wouldn't put the house in her name also, built a new home, borrowed against her house and not tell her so when she ups and leaves, thinking she'd get some money out of it he sells it and don't give her nothing so yep she's suing him big time.

I really don't have money for a lawyer and no one I know here in Ky at all to get advice from except close family. But if I have any trouble at all with him with this loan I will some how or other talk to one here locally, I just have to.

Well the Lord told me to stand up to him if he comes monday and causes trouble with anyone here fixing the roof and he will have angels standing in front of me. Those angels could be the guys working on the roof.

In 2005 my husband died, and I'm on disability. My sister talked me into moving to Ky and my nephew had a house for sale for 45,000, he owed 16,+ on a second mortgage and the balance was like 29,000 +-. He said he'd sell it to me on like rent to own but wouldn't give me a contract afraid any creditors I hadn't settled with would take the house. I owe sears and had been paying it till a year ago. I had a little insurance from my husband's workplace and needed somewhere to live and the payment on the house would be cheap, so much cheaper then I could afford in Indiana. trying to shorten this. Well I gave him 16, + to pay off the second mortgage. I know I have to keep up things on the house. The deck is rotting, saying I didn't treat it and I did and the roof over the porch started leaking off an on. I finally got some free help for it come Monday. But he started in sending nasty letters about the grass not mowed. My brother mows it on his days off every week or 10 days at the most depending on rain. He has sent nasty emails when I told him I want a land contract and threats so I talked to a lawyer in lawyers.com and that made him even madder when the lawyer said no contract no money. I paid him that 16,000 for the loan and I know it was paid off cause I wrote it right to the bank. And i've made the payments on time every month including a few dollars extra to go on the principal for 4 yrs in Dec. He is constantly sending me nasty emails saying I'm not keeping up my end of the agreement with repairs. I'm putting a new flooring in the utility room right now after the washer flooded the 5 layers of carpet and I found very bad mold in them. last rug? the company been in business since 1865, no kidden. Now I have some one coming monday to fix the roof, he says now any repairs he has to agree to and is to be here when they fix the roof. AND if I get some one and not tell him and he comes by and they are working on the house he'll make them leave. I know i need a lawyer but I can't afford one. Is any of this legal for him to do?.....I'm at my wits end and ready just to throw in the towel and move back home but i have no money to do that.

I am trying to get a loan but with my poor credit that occured when my husband got sick and all I'm not sure I can get one.... I went to his bank that had the mortgage thinking that might help me better to get one. They won't call me back for some reason

One thing I did do was sell a carport he had out there and maybe I shouldn't had but I figured it was ok, he and his brother both wanted to buy it. So I thought nothing of it besides it was an eyesore and no use to me and I want to put a patio in out there and a pond and garden. My brother already has some of the material to do that next spring.
