Sorry, everybody for the punctuation and the Spelling and grammar I’m really not that bad at this but it is after 1 o’clock in the morning. I had a really busy day after reading it over to myself It was very embarrassing. This is my first post so please accept my apologies. Have a good night everyone

I have a question to ask and I really don’t know what is right or wrong so I met somebody in January and we agreed that my fiancé and I would move in to the home on 1 February. Love this beautiful home. It was exactly what I wanted and even talked about us purchasing the home after our lease was up. The owner of this property bought the home on December 28, 2022. We signed our lease on January 5, 2023. We moved in February 1 is what our contract said after moving in get everything set up a cup asking everybody to come into the house, “what is an awful smell?” Nobody seem to be able to smell what I was smelling almost felt like I was going crazy because I could smell this odor. Sometimes it was stronger than the other days. I tried to convince myself that it was just the dogs because they were able to run and play the yard was fixed it.
Long story short, we come to June 1 2023 my father head came in the beginning of the month and stayed for a few days and the smell was extremely bad. I was very embarrassed, because no matter how many candles I had the smell was just not going away by this time I was getting bad headaches every day coughing sleeping all the time to the point where I went for full time at work to part-time work I saw when it rained in the porch where it was screened in right by the front door. I told him three times from time to time that when it rained really bad that it would run down the wall and make a big puddle, so obviously that meant rain was coming in through the roof in between the walls, we started seeing where there was spots of mold in the kitchen cabinet by the sink. I was like that’s where the cabinet is there’s a lot of water just made an excuse. June 26 I moved my vacuum, and the whole wall had fallen in due to moisture standing water under the crawlspace  which obviously this explains the smell because it was standing water from the time I started living there all the way up to the time that he started fixing, it which was around the middle of July. He fixed the windows, and don’t let me forget that the hardwood floors, real true hardwood floors were warped, completely warped, and in the kitchen. It was coming up and could see underneath the wood and he did not seem to think that was a problem he could just cut the one piece out and have it fixed. He never had a certified mold specialist to come to the house and look at it test it or see if it was ever gone. Of course, she said it was fun but it was clearly not if I left the house for a few days like I went to Florida for a week and I  was completely fine never used any medicine at all the whole time I was gone I came back and after being back about 30 minutes  I sneezed probably 20 times have a horrible headache. I went to sleep, welcome back home to me .

He is  trying to get the water out from underneath the house. Needless to say there was extreme extreme mold in the house. I was very sick. Went to that doctors many times  with them being at the house to try and fix it I was not able to work because it would’ve been a HIPAA violation from my work because I work for medical field. In the meantime, I did not pay him rent because telling him I was sick and didn’t really know what to do and that my dog was losing hair  out of his mouth he told me if I was sick and my dog was dying that I need to find another place so I did I sent him a letter on September 10 that we would be moving out and I would like my deposit back because the house was not damaged any worse than when we moved in. But I did not get no response from him. I had six or seven fans under the house a big dehumidifier under the house and one inside the house. The bill for the power went up extremely high between 750 up to almost $1000 a month just for my power bill  two days after I sent him the letter telling him that we would be moving out on October 1. I get a knock at the door and it is a sheriff and being served with addiction papers. At this point I am very, very extremely upset the next day he comes to my house  being as mad as I was and I have been working so hard on my credit since the last two very ugly relationships that I had,  I want to be able to buy a house or the house that I was in before all this happened and doing an eviction on me, is will my credit  and I was so upset I already have severe PTSD from past issues. I asked him to please not do this to me that I had told him I was already moving out and he chose to file the paperwork anyway I went to get a hearing filed for that to not be on my record  he was also asking for too much rent that I didn’t pay and some crazy late fees on the vision. We both agreed that we would go into the hearing and agree to just have the voluntary termination so that way it was not an addiction on my credit the judge asked him several times over and over  are you sure that’s all you want are you sure that’s all you want just the termination of the infection is everything fine are we good? Yes we’re fine she concluded and we went on our way when I moved on the first after I got completely moved clean the house. Everything was fine. I asked him if I could get my deposit back  he said no he was holding that for the late money that I owed him and we would just forget about the rest. But for one, he never had that inspection on the house after he bought it so that is negligence on his part, by putting myself and my fiancé in a home that is not fit and habitable and by human rights and the landlord tenant act, to be living in which made me very very sick, which makes this considered not a safe or livable home.

He’s also the one that told me to move out if I was sick and he’s also the one that said that everything was good with just the termination of the lease. Please let me know your thoughts about what the landlord has done what I should have done differently. I will say that since he will not give me back my deposit that I am suing him for the deposit and lost work wages because there is so much moisture in my house. You wouldn’t believe it, but I had standing water in my dryer all the time literally water in my dryer my washer and dryer ruined. My furniture was brand new and now smells like mold so I did take him to court for these things. I feel that I should be paid for what I have went through and what my fiancé has went through. I do have a doctors note also of how the PTSD has been extremely bad since this whole thing has been on from July until now  to almost having a breakdown and ending up in the hospital. I’m not a mean person and I do not like conflict. Will you please just give me your opinion and let me know if I am I in the wrong or not thank you for your time and sorry this is so long. This is the first time I’ve ever done this.

Thank you,

Tracy
