Thank you Jon that was just the answer I was looking for I was thinking the same thing, but one more question could I do a separate contract for the end buyer while the owner is still in the house and if the end buyer agrees to finish the eviction and I would discount even more I can do that now or do the Keys for cash first then get an end buyer.

First thank you for the reply, but as stated I have a contract to purchase and I am contacting to lawyer to see where he is on the eviction, but you are right one of the things I was going to do was offer cash for key instead of going through the time for the eviction. It not complex I work more with performing notes and I came across them selling the NPN a year ago, but now it's the property. Nice home in MD, value over $700,000 5bed/4bath on 3ac contract for $530,000 and the reason why I am asking these question is because I was looking at my options if I could sale the contract.

I have a contract to purchase a SFR REO, but here is the problem the owner of the property is still in the house, but the seller of the REO has already foreclosed on the property and they are in the process of the eviction with the lawyer. I am able to buy it now before the eviction is completed for a better price, but that means I would have to pick up where the seller of the REO left off with the eviction. My question is as of right now am I buying the non performing note to the property since the owner is still living there and the eviction process is not done or am I buying the REO.
