Yes, But I am a nice guy. I treat people the way I expect to be treated (which is why I am always  transparent with Home Owners).  Even those trying to cheat me.

The change of work specifically states the issue at hand, what is necessary to fix the issue and the increased cost to the original contractual agreement (material and Labor).  This was required to move forward and required a City inspection.  I was very transparent with her during the entire process.  

I will be filing a lien after the new year.  Do not want to file during Christmas

Thank you for all the responses.  Everything was spelled out and additional work is placed in a COW .  She is claiming I misled her.  I not only have photos of the problems, I also have text and emails and she viewed the problems herself.  I explained exactly what needed to be done to bring it to code and the cost to do it.  I  provided the change of work with a drawing of the issue, plus photos of the before and after.  Now, In fact, she claims the additional work was not agreed upon because I did not provide her with a cost, then she said I overcharged her for the additional work, now she is claiming  she never agreed or excepted the original estimate.

I have time to file a lien, and I will be required to file a suit against her, however, this is a tax question, not a legal question.  I have a CPA, but I thought I might find out from this site.

I finished a remodel for a lady in texas.  At the end of the job she refused to pay the final bill stating, "i am disputing the bill so I do not have to pay all of this".  She then began to claim items that were not part of the contract that she wanted done (ie. repaint her interior, fix her floors, and repaint an addition).  I paid to have that done and did not charge for it.  She still refuses to pay.  this is a significant loss to my startup business.  Now that the year has ended, can I provide her with a 1099-MISC as earned income.
