This could have been a very foolish move by the seller.  If there was already a buyer and they entered into an agreement with an agent you may still be able to do the deal but the seller would have to now pay a commission (assuming exclusive right to sell agency)

I think multiple comparable properties should be considered when looking at CMA. Get a solid range and as other posters have mentioned, a little wiggle room doesn't hurt when negotiating.
