Thank you. We went to go visit him today and he said he started legal proceedings against his tenant and I advised my client to do exactly the same thing, which he will be doing tomorrow. Thanks again.

So my clients closed on the building at the end of February. We have seen all the apartments and they are in beautiful shape. The apartments are all rent stabilized save for one. That apartment is the super's.

The super has been living there rent free for the last 18 years. He told the buyer I know it's your time, when you need me to leave just give me some notice. He has his own property a few blocks away with his own tenants and needs to get them out so he can move in. On March 15th the owner went over and offered April 1st as a move out date. The super suggested he needed until April 20th. The owner agreed and they signed that he will be out. One of the other tenants wants to move into the apartment, which will destabilize her apartment giving them 2 free market apartments. April 20th has come and gone and the super is still there. He says his tenant has not found a new spot so he cannot move. He is still collecting rent, while my client is not collecting a dime.

They decided to give him a few more days (I told them not to). May 1st they went over and told him he has to start paying rent. He basically told them that he hi trying to evict his tenant but he will not pay them rent.

What would you guys do? He has no lease, I pretty much consider him a squatter. Can they cut off electricity/heat/water to his apartment? Once he is out can they sue him for back rents? I am going over tonight and basically telling him if he is not out by Wednesday he is getting taken to court. Any other suggestions?

Hi,

I know this probably isn't the right forum to put it in, but I didn't know where else to put it.

My client just bought a 4 story building in Brooklyn, NY. We are currently soliciting wireless companies about putting cell towers on the rooftop. First of all, does anyone have any tips/advice/suggestions on this route. I have been in touch with both the companies directly, as well as tower companies who build the structures themselves and then get wireless companies to lease space for a percentage of the revenue.

Secondly, I started thinking there has to be additional ways to generate income from the property. Would love to hear some creative ideas from the BP community. There is no parking lot, driveway to rent out so that's out the window. I'm waiting to hear back from Verizon to see if they will pay for the right to install FiOS in the building. Another idea we had was to rent out the basement space to a local yoga teacher or something of the sort. Another idea was to put laundry in the basement but the owner isn't too keen on that.

Would love to hear from all of you.

Hi Everyone,

Just wanted to know if anyone has dealt with a Sheriff's Sale Foreclosure. It's the first time I've come across this in NYC. Most of the time it's traditional mortgage foreclosure, tax liens or Estate sales by the public administrator.

Why does a Sheriff sell a property? And does anyone know how clean a title it should be? ie when buying from a public administrator the deed is delivered free & clear.

Hi All,

Aside from sending yellow letters to lis pendens, and reaching out to the probate market I have also compiled a list of absentee owners in the section of Brooklyn I want to reach out to (A very hot market that is gentrifying exponentially).

A lot of the owners are still within New York City and the 5 boroughs so a lot of them probably know how good the market there is. That being said, I like to talk people, both those in the know about real estate and those not. A lot of people who are not in real estate don't yet know the rise in this particular neighborhood. My question is do you think I should first reach out to the people outside New York City, in NYC, or it doesn't really matter?

Also, would you go the letter yellow route, phone call, any other way?

Would love to get your take on it.

Jerry Puckett Thanks for the quick reply. Is the Notice to Creditor given after the Letters Testamentary has been received (after there has or hasn't been any objections to the Letter Testamentary). In this case, if there are no objections would Terry Hatcher be the Executor or PR?

Thanks Michael - I sent out letters from December and January lis pendes. Mailed them yesterday so that they arrive on a Saturday (My understanding is people are less aggressive on the weekend)

Hi Everyone,

I'm starting a yellow letter campaign to get properties to promote to buyers. I have a list of Lis Pendens in NYC (specifically Brooklyn) that I want to send them to. I have a list dating from Jan 2011 until present. Do you suggest I first send to the older ones or the more recent defaulters?
