Thank you for your detailed response. The challenge is, these issues are not easily fixable. We were hoping that they move out, as they told us previously and we can then look into these issues. The water leaking in the basement may require us to open walls, it may break old sewer pipes and make house not liveable at all. Rodent will also require to put traps, maybe use rat poison etc and not easy when someone living there with a kid. It's not we have not tried, we have tried to address these issues. 

One question I have for you: who certifies that house in not habitable?

Currently there are two main issues, rodent problem and something is leaking water in the basement. As I mentioned earlier, we spent close to $3k in the last month without getting a single penny of rent. We recently hired someone to close all gaps to prevent rats from coming into the kitchen but they are still finding ways and it's not an easy fix. Tenants told us that they are looking for another place and we did not push for rent and we were thinking about fixing these issues after they leave. It seems they are fooling us, October started, rent due date has passed and we did not get this month's rent too. We understand that issues need to be addressed but tenants cannot just live in a place without paying us any rent.

What makes a house uninhabitable? The tenant is living in the house but not paying rent and threatening us that she'll call township since house has issues. How worried should we be? Or should we start the eviction process?

We are an LLC. Can we give notice on our own or need an attorney for it?

Rented my first rental property recently and now tenant is not paying rent. Did not pay Sept rent's and Oct's rent is over due now. She moved into the house in Aug and paid first month's rent. The house had issues and we gradually fixed them. A couple of issues remain, which includes rodent problem, which is a block wide issue. We stayed quiet in Sept because we realized that we need to address tenant's complaints however now they think that they do not need to pay us until we address everything. We spent more $3k on the house without getting a single penny and it is breaking my back. What are my options? Thank.
