Hi all,

I looked up some of the discussions on land trust and still have a few questions so asking for clarifications.
Here is my scenario: Have a few rental properties, most with loans and few no loans. Currently all of them are under our revocable family trust as owner. I would like to put them under LLC - the goal being liability protection. While I can do so for properties without loans, I am wary of moving the ones with loans into an LLC as that may trigger the bank to treat it as a sale. The properties are in different states.

From discussions what I understood is that the steps are:
1. Create a land trust :  One for all or one for each?
2. Create an LLC: One for all or one for each? Should they all be in same state? Matters?
3.  Make LLC a beneficiary of the land trust
4. Move properties currently under family revocable trust name to individual land trust.

Did I get is right?  Any tax implications in doing this?

Quote from @Mark Waite:

You won’t be able to charge as much as if you had an ocean view, but your acquisition price is going to be far less as well. I always tell my clients to look at the difference in the nightly rate of comparable ocean view versus a non-ocean view properties. You’ll find the ADR difference is not that great, so you’re going to have to rent a lot of nights to make up for the additional price you’re paying for an ocean view.

As for comments about an HOA, that's part of doing business here. But if you run your numbers, you should have already factored that in to your monthly expenses. It's no different than someone who owns a house and Hass to pay for a lawn service or a pool service. It is just part of doing business.

Thanks!  That is what I have been thinking too.  Wish me good investment luck!

Thanks! Agree a SFH or a unit without an HOA has better returns in many places. Unfortunately in Maui that is not an option.

Hi experts,

I am relatively new at this although we do own a STR in Kihei region with some view. I see an opportunity in Lahaina with no ocean view, some mountain view and that is priced lower but has great interiors and is STR able. Are STRs with ocean views the only ones successful? Worth investing?
