This is the last text I got from landlord. - the cleaning of the house will be $450.00  and you will see $350 shortly.please keep in mind that it this doesn't work and painting is required i will be filling a warrant in debt against both of you.added on will be attorney fees and 6%.- So can he still sue after the fact of sending partial security back. I'm thinking that's satisfaction on his part if not why return any.

May I also add he is no longer trying to rent.the house was up for sale 3 days after we moved. Within a month the price dropped 3 times. People aren't buying it because it is a complete remodel. Not because of smell. He's using us to fix it up on our dime. 4102 Dartmouth st Portsmouth,va..also no physical damage on walls. They are not yellow they are white. The floors are a complete redo.

I am absolutely sure lease does not state no smoking. Nothing has been done to this house in sure since 1950. The walls are stucco/popcorn paint and ceiling. The place was not painted before we moved in. As we did a walk through they noted the spare room needed painted it we wanted to. There was a leak in ceiling and you can see 3 patch jobs.I kept the door closed at all times cause of a moldy/musty smell. That's what I smell. My other point is we were from Pennsylvania and our daughter looked at property for us and when he walked upstairs he noted then he smelled cigarette smoke and said to my daughter that he told the guy he didn't want him to smoke in side. So when I brought that to his attention he said he told her he smelled smoke from a burning barrel. Lol also during our walk through our in the garage the door opener wasn't working so he asked me to help him,mind E you i was smoking a cigarette.I live in Virginia and it says I can use for 3 x my deposit. I believe I'm going to see a lawyer for a consultation. When I stated taking him to court he in my eyes threatened us by saying you won't get very far because I know all the judges and they won't hear our case. He is a sheriff at the court house. That's crap.

My landlord is withholding my security deposit cause he says i smoked in rental.plus $2500 for painting. Can he do this? I am a smoker but I only smoked outside and garage by the doorways,never in house. No where in leases does it state no smoking. We did our final walk through and he says all looks good except he smells smoke.mind you i just finished a cigarette in the garage while he was present. He never spoke a word to us till 30 days later when he should of been returning my deposit then he wants to blow up my phone. He states he can't rent or sell property due to smoke smell..I doubt that.the house was built in 1951.there are numerous cracks in ceiling from house settling, wood floors need redone plus two round stains from kerosene heaters from last tenants,the bathroom is original pink tiles, kitchen cupboards falling off walls,leaking roof,leaked prior in spare room was patched and never painted, the whole house is a fixed upper.I think he's trying to pass the buck onto me so he can repair to sell, not due to smoke smell.Can I take him to court for my refund or will be win.I live in virginia
