PM gave me an anecdotal story about a similar situation he had with another landlord and tenant. I'm sure there are differences in the details, but the landlord ended up losing and paying out of pocket even after insurance, etc. This story scared me off from going down too hard on the tenant in fear that I could be in the same boat.

I guess I just want to understand the actual law in regards to handling mold issues. I know the law is very strict and I could get screwed if I forgot to perform a certain action. I was hoping someone had first hand experience with this topic.

Thanks Jon for your response. PM was not doing anything due to fear of retaliation for the mold issue. Basically tenant already stated that he would pay and then leave voluntarily within a few weeks, month, then months. Never paid and just left during the holidays.

I guess the main question is if the tenant has any legal recourse if he is able to get a doc to sign off on some health issue due to a possible mold environment.

Hard to say if the tenant has any assets right now. He was making around 75k before getting laid off and I'm sure he will be able to find another job that pays decent money eventually.

Tenant informed me of mold issues and I put him up in a hotel room immediately and took care of the problem. Took about 2 weeks from start to finish. The mold was caused by the AC unit which leaked water. Tenant did not notice for months and mold formed. Fast forward a few months and tenant lost his job and stopped paying rent. He moves out without paying 3 months of rent. Now property manager is telling me to move on and not bother going after the tenant for the lost rent since the tenant might start complaining (faking a cough or health issue, etc) about the mold issue from months prior. He said the tenant can always sue me for a mold related health condition.

This doesn't sound right to me since I took care of the problem ASAP when reported. Any truth in what my property manager is telling me? Lost rent is about 6k (2k a month). Thanks
