Thanks for the quick reply. The third party company did it for a fee. I called b of a yesterday but my file is still with b of a home retention department and they wont release the file to active status and wont postpone the 9/18/12 sale. The person who's in charge of the file was giving me a hard time. I called the trustee and they said they couldn't postpone it without B of a's authorization. Everytime I call b of a regarding my account, it goes straight to the person who's handling our account and it was no use talking to her. I walked in a b of a branch hoping that they could see my account from their end. They said that payment has been received and the september mortgage is due but we couldn't make a payment for septmber bec they wont accept it.

Here's my situation. My property was up for auction sale on 9/4/12. B of a declined our loan modification and i haven't paid my mortgage for 20 months so Im in default and the house is now in foreclosure. I called B of A on a 9/3 (labor day holiday) asking them if I could reinstate the account to avoid foreclosure, But they said that it will not be a guarantee that they can postpone the sale. B of A gave us the amount to pay to bring the account up to date and they even asked us to pay thru western union. So she gave the payment instructions. Fortunately, i have a friend who's willing to help us out and she lend us money. I called B of A again saying that we have funds and we are willing to pay but the lender is still hesitant to postpone the sale. We tried calling the trustee the next day 9/4/12 and told them about reinstating the loan. They said that only B of A can postpone the sale. I was losing hope and I went online to search for solutions to stop the auction sale. One company called me and told them the situation and we are willing to reinstate the loan. We only need to buy some time to make the payment before the auction sale. I still went to western union to make the payment before the actual auction sale. The payment was done 1 hour before the auction sale. I called b of a and gave them the payment confirmation but despite of payment they still dont want to postpone the sale. I called the trustee and mentioned that the payment was made the reinstated the loan. The power to postpone the sale is still with b of a. I was so hopeless because i dont have much time. Luckily, the third party company that i called to help us postpone the sale went thru the last minute. The auction sale got postponed and rescheduled on 9/18. The reason for the postponement was bankruptcy. I am not sure how he did it but it worked eventhough the actual filing of bankruptcy never happened. Now my question is, can i request for permanent postponement of the auction sale since my account is current and up to date? if they asked for bankruptcy, can i tell them that i changed my mind and never moved forward with filing it in court? I dont want to lose the house and reinstating the account was my last option thru the help of my friend.
