We are at a point where we need to evict a tenant and want to follow the process judiciously using a lawyer who does this in his or her sleep.

Hello All,

Need your opinion.

A renter continues to be behind on making payments. He is now late and has not caught up with payments for the 2nd month running. He has also previously made payments using his debit card that have failed in the past (he sent us screenshots thinking we'd not mind it, but it fails). 

Right now,we've worked out a deal where he would pay $1000 weekly and try and get back on track. A friend advised that I sent a default notice via registered and regular mail. Any suggestions for ensuring I have done due diligence before eviction troubles arise potentially?

Kindly advise!

One rented, then you can assess your losses and send them a bill for money do realizing that you have very very little chance of recovering any money in Texas. Even if you go to small claims court and get a judgement with Texas, the chance of collecting is slim at best


 Agreed Greg. My property manager was able to get in there on Tuesday and assess alongside the tenant who was kind to be with him at the same time. I did go ahead and send out a note requesting payment for the current month as well as the one-time cleaning expense. Thank goodness there were no major damages or issues otherwise.

This situation is a lot more desirable than a tenant who won’t pay and you have to evict.  I’m in the process of an eviction now, and yeah we will get a judgment for the unpaid rent and stuff but we know in all likelihood we will never collect on it 


 Agree 1000%, I have a situation with another property in the same city where we're waiting for the tenant to come through today and make a partial payment. I will need your support to draft out the process and understand it as we're headed there.

My property manager got with the tenant and did a walkthrough of the property - thankfully no major damages other than the usual nick and scratch here and there as well as general cleaning that is required. 

The tenant went ahead and signed a lease termination notice on his own. I have not countersigned yet.

I have asked that the tenant owes me monies for current month's (August) rent (I have already applied the deposit to previous month's non-payment) as well as cleaning fees which I believe are reasonable. He has requested time to arrange for the payment. But other than that, I am not going to pursue the lease term payments for months that follow.

I am curious as to how to pursue lost rent or perhaps you can guide me with my predicament. I can claim the unpaid rent for July from the security deposit but for August, I have limited recourse. Would you consider such a path? 

Hello All,

I am a first timer here, and was recommended by a friend, so apologies if I havent posted to the right forum or used the right language.

I am a landlord of a property (my first) in Von Ormy, south of San Antonio. The renters signed a 1 year lease with a 1 month deposit in late March.

However, they missed paying me rent in July and upon calling them this morning (after 2 offline requests), they informed that they have vacated the premises over this past weekend.

I need help to understand how I can repossess and show the property around given the lease has been broken.

Questions for anyone who can help...
1. Is an email statement from the renter sufficient where they indicate they have vacated the property and that it was their own decision or do I need to do something a little more formal here?

2. Can I repossess property as early as tomorrow?

3. When in your opinion can I list this property back on the market?


I dont plan on taking any action as it relates to early lease termination. Any guidance is appreciated please.
