Just purchased recently a small condo cash. There was a trap in roof however I been told by realtor and inspector that it will be replaced and there was no known leaks. I got a tenant two weeks after closing. I wasn't able to get insurance. The agent usually get insurance from said once they fix the roof then I can sell you insurance. I saw the building has tenant and even upstairs which is direct to roof this one I got in first floor. So this reason I rented the unit. Ten days after tenant moved out it rains and few hours later she said she had some minor leak. I had someone took video and it was few dripps. I contacted the hoa about fixing roof asap and also other owners nothing been done yet till today they keep giving fake promises. anyway, the tenant seems wanting to take advantage of the situation she called me once qnd said both her son and grandson slip and felt and she called ambulance and they are ok. I offered her before this event to move out and honor deposit back even contract building is 6months lease also wafted some negotiation with HoA they offered to move her to alternative unit. She moved out exactly a month if stay there and they left the place filthy also her son is not on the contract and I been told that many of them were living there while contract has only two people. So now I got a letter from an injury lawyer not in the LLC name (the property owner by LLC ) but in the name of the HoA however the LLC address not the HoA address (the law firm seems confused it idk). Please advise on what to expect what to do? And any recommendation to law firms to consult on this. Also I feel that previous owner realtor inspector and HoA the ones should held responsible for this.

Thank you for your response. I havent gotten an insurance for this and a week after close I consulted some insurance provider and he didnt offer me insurance options. No mortgage on it. And also I inherited the tenant and havent signed lease with them been advised to better honor the same terms of the seller until their contract finish. Its a month to month and im in a weak position even to ask the tenant to renew lease now and they seem they are willing to stay they just need a solution to the issue. My options are very limitted and the situation is very draining even I follow the bigger pocket advises and I unvested a lot of time in learning and also have years of experience with tenant. Usually if it is something no HoA I solve the issues but now the prolem is under the HoA mercy that seems to careless and the water damages are severe and scary on the photos.

Hi everyone,

I recently purchased a rental property in a condo managed by an HOA, and I'm dealing with a challenging situation that I'd appreciate advice on.

Shortly after closing, I discovered that the roof above my unit (a common area under the HOA's responsibility) was severely damaged from a past storm. Water is now leaking through the ceiling into my tenant's unit, and it's worsening with every rain also the neighboring unit has sever water damage (like a pool inside and it is owned by the HoA) and water from it leaking very dirty water from the shared wall to mine. The HOA has acknowledged the roof issue but claims repairs are delayed as they’re still collecting bids. Meanwhile, water damage is spreading, affecting my unit and others.

The tenant is understandably frustrated and has mentioned safety concerns due to slipping hazards caused by the water. They’ve also indicated they might move out. I’m worried about:
- Liability if the tenant decides to take legal action.
- The increasing cost of damage repair and potential mold growth.
- The HOA’s apparent lack of urgency to fix the roof.

I’m considering consulting an attorney to explore my options, but my budget is limited. Can anyone advise:
1. How attorney fees typically work in these cases (e.g., hourly, contingency, flat fee)?
2. Are there any cost-effective ways to handle this situation legally?
3. Would it be worth seeking a free consultation with a real estate attorney to evaluate my case?

If anyone has faced a similar issue with an HOA or has suggestions for next steps, I’d really appreciate your insights.

OMG I can't tell you how disappointed I'm from real estate agent which is really a thing I don't wan!!!t. So I sent an offer in a condo that was priced for a great price great location all the appliance and bathrooms are brand new.. So that I find out doing my own calls to find out why the offers was denied even was just so close from asking price and Im willing to go with second offer, I found out that the place has reserve litigation issue and my agent who I rely on and keep emphasizing how we need to work smart dropped the ball again on me and didn't due enough diligence even he claims he knows how to do property searches etc etc which made me feel its an extra that he has, it was very sample to just ask the listing agent so not to waste my time neither his sending unnecessary contracts... The question here is how can I rely on myself doing more diligence when it comes to liens, issues with HoAs that may have financing declined or things that may affect me when buying cash!? Is there any websites or platforms that I can add to my knowledge that help with this diligence at fair/free cost? Thank you

how do you guys go about separating your residential address from getting mail from tax etc from your investment property? What virtual address services or any other have you or recommend to use as mailing address?

Anyone can suggest in Florida, Tampa or Orlando area that does tax strategies and asset protection. What tips have you guys been using as starters to start with peace of mind on your asset protection journey? Im planning to know procedures and plannings that are affordable for rookies until grow more and be able to afford a bigger firm who does things the right way.
