Larry, very interesting post since this is almost identical to what I'm considering doing. Just out of curiosity, what kind of terms did you work out with your friend? Are you going to pay him a set APR for his money, or just a portion of the ongoing profits and/or proceeds from the final sale/refi? And is there a deadline or any sort of timeframe when you have to pay him back by?

My opinion is that since it says "pet deposit", as opposed to "pet fee", it is refundable.
