Husband and wife have community property in California, the land lot value under $10k, wife is disabled and now living in a nursing home. The husband does not have the power of attorney. Is he able to sell this land lot by himself?

Husband and wife have community property in California, the land lot value under $10k, wife is disabled and now living in a nursing home. The husband does not have the power of attorney. Is he able to sell this land lot by himself?

I have a land lot, the owners on a Title are husband and wife.But the wife now is in a nursing home and not able to sign documents.The husband doesn't have a Power of attorney. What should we do to be able to close this deal?

The Trustee of the Trust has dementia, so her son is the Executor and has Power of Attorney. To do a self-closing transaction for the purchase of the vacant land lot, should I prepare documents where she is a Grantor and he just signing documents for her as an Executor?

Or there should be something more complicated involved?

What document should I sign with “sell by owner” transaction for the land purchase deal if the owner of the property is deceased , but he has a wife, she is alive. Property located in California . As I know in California is a community property State. But on the Deed there is only his name and written “as his sole and separate property”

Can his wife in this case sign an Affidavit and a Grant Deed?
