If the sellers failed to disclose a defect of that magnitude then you would have legal recourse. The fact that they cleaned that carpet could indicate that they purposely meant to mislead you and your inspector. I would suggest you contact a lawyer and explain the situation. I suspect the lawyer will advise a lawsuit given what you've told us.

Regardless of your intention if you treat applicants differently you could risk a lawsuit on perceived discrimination unless you are exempt from the Fair Housing Act and there's not any state or local statutes that may come into play. If you provide the lead based paint disclosure and pamphlet then you've done all you need to inform the tenant of possible risks associated with the old house having lead. Perform the showing and search for more applicants if you like and pick the most qualified.

@Dan Mackin I haven't finished the flip yet (just purchased it actually) but I'm trying to formulate an exit strategy early on. I finished my first flip earlier this month and it went really well so I'm looking forward to the next one. Thank you everyone for your input.

Hello everyone, I've got a rehabbed house in Aurora, Colorado where the margins are a bit tight and so I'm considering doing a FSBO and have a few questions:

Do I require an attorney or can the title company perform the closing services?

Is it worth paying a brokerage to list the property on the MLS while I perform the marketing and showings?

Does it matter much which title company I use?

Any other marketing tips or other advice for a newbie? I've never done a FSBO before.

is it best to always receive a loan and purchase property under an LLC since trying to transfer it from your personal name to an LLC would invoke the due on sale clause?

I've always had an interest in economics and I feel that the best way to be on the lookout would be to examine a variety of factors. I'm interested what you guys and gals feel that the housing market will become as inflated as it was right before the 2008 bubble popped or if it'll happen sooner or later than that.

Hello @Dan Mackin, I've recently read the ultimate beginners guide and found it extremely helpful. I have started a career in water treatment not too long ago. I've been considering getting a real estate license to get access to the MLS. Do you think that that'll be worthwhile in order to look out for good deals? At this point I'm still doing what I can to learn as much as I can about REI.

My name is Sean Shirvan and I'm reading a lot here on BP and it's definitely a tremendous resource. I'm 23 years old and am interested in doing buy and holds. The market here in this area is crazy and it's gonna be fantastic getting started. I'm looking for any sort of advice for a beginner like me. I likely cannot qualify for a conventional mortgage at the moment so I'm wondering what the best way to get started possibly using an alternative financing method without making any major mistakes.
