1. Can any of you please advise how we can get the judgement ? We now have few tenants who already moved out and we have one who will move out this week as a result of the eviction filing.

2. Do collection companies only take the unpaid rents with the judgement, or they also take the one without the judgement ?

Hi, we are working on rehab a SFR(4bed, 1800 sqft, split level house, built in 1960s) which has large (approx 3000 sqft) bakyard with a downword slope from the house. Currently, the yard is messy with grown up weeds although it was originally lawn bedded.

The front yard is a decent size (1000-1500 sqft) with lawn (also lots of weeds).

Can anyone suggest how to landscape the backyard (low maintenance and low cost, and nice looking!) ???

We have handful rental properties and manage them by ourselves. We have filed eviction to local county court numerous times and tenants moved out. However, we have  never been able to collect unpaid rents (typical amounts few thousand dollars, 2- 3 months worth of rent). What is the realistic way of collecting unpaid rent, even partially ? Using a collection company, filing a claim to munincipal court ??

I have asked this questions to local REIA members, but no solid answer was provided... Do landlords simply give up ???

Hi if you own both handful rental SFR properties which is generating CF nicely (12-15% ROI),would you do multi family or keep investing in SFR ?

thanks Sue ! this is a Chapter 13. do you know what's gonna happen next after I received this receipt  ?

Hello,

one of our tenants had filed a bankruptcy (Chapter 13) and left our rental home with  unpaid rent of approx $3K. I went to the Creditor's meeting held at US bankruptcy court in Atlanta, GA. But the tenant did not show up. I filed a "motion" to the court requesting the court Not release the tenant from the unpaid rent. Few weeks later, I received a letter from the court asking me to pay $350 (I assumed this $350 make my filing valid), thus I mailed $350 check to the court, then I received  a receipt of $350 from the court. Now, I need to know what to do, as there was nothing mentioned in the receipt. I am going to ask the court what to do. However, If anyone can advise what should I do, it will be greatly appreciated.

With the final response from Clay, the judgment on garnishment on Tax return  is the new concept for me. Over now 4 years managing properties by ourselves, we have learned so many people (tenants) who are not responsible....

Screening is the first and the foremost in this business, thanks again all.

Hi we have been managing 15 + rental properties (SFR) and been to eviction courts numerous times, but have never been successful to collect unpaid rents.

I understand following ways exist to collect unpaid rents.

1. Get a court judgement to garnish from the (ex) tenants salary, if the tenants is employed by someone. - I have not been to a municipal court to file a small claim. Is this realistic ???

2. To put a language in the lease agreement to bind the tenants to pay the outstanding rents and/or repair cost to put the property back to the condition as same as the time of move in.

I am well aware that Choosing a "performing" tenant is a key component to maximize ROI. In the meantime, I appreciate anyone's advice on how to minimize the loss (unpaid rent/unrecovered repair cost).

Thanks much for your input ! I will check the info provided.

My point was that there are many tenants (low income) who want to buy houses, and enough income, but just do not have skill set or discipline to set aside for onetime rent payment and down payment down the road.... Some system/set up to motivate them can be helpful. Lease option may only work if the owner wants to sell the house down the road. But, it does not work if the owner want to keep the house....
