Most of the times property encroachment is a honest mistake and very rarely it was deliberate. Just by looking without a survey you would not be able to judge the boundaries. This has to be dealt at an early stage because in the part of the world I come from encroachment is sometimes covered under adverse possession law, where if the neighbor uses and makes improvement in our property and pays taxes the neighbor is entitled to take possession after a certain period of time. I am not a lawyer and not aware of this here but still I would check it out.

If it was my neighbor I would politely request this has to be corrected and 95% of the time works out that way but in adverse situations you might have to involve the court.

Anybody correct me if I am wrong.
