Thank you for your response.  We are now verifying if the people living in the property are in fact family members of the owners that are moving out or if they are leasing.

We were under the pretense that the property was going to be vacant when we signed for the property. Someone else said we could use that to back out and get back our deposit or have a contingency to close that the property is vacant or our EMD refunded at that time.

Any thoughts?

Wednesday I signed a contract to purchase a property in Dallas and wired my EMD. I was told the property was vacant. Last night I was told the opposite that there are people still living in it. There is nothing in our contract stating a leaseback. What are the rules to get people out of the property if they are still there after closing? Again, this is Dallas, Texas. Please advise. Thank you.
