If it is a judgement lien against the property, will it get wiper out? In other words, if I am a buyer, I won't need to pay that?

I am doing research on a foreclosure property and found that the owner has an "abstract judgement" recorded with the county. How do I know if this is a lien against the property?

Help!

My transaction is supposed to get funded today and close tomorrow. My down payment has already been wired to Escrow. But the sellers want to back out. What options do I have?

Anybody has any similar experience?

Now looks like the seller assumes most of the risk with "subject to". Then how could you honestly convince them to do so?

If I buy a property subject to the existing loan and later on stop the payment, whose credit will be damaged if the bank comes in and foreclose the property?

Many thanks for the reply.

I contacted the attorney. He was saying that the check needs to made payable to: Estate: (the decedent's name)

Since this is the first case for this attorney, I am not sure if he is right. Does his answer make sense to you?

I am preparing for a probate sale auction, and having problem with the deposit check. I don't know who the check should be payable to. My guess is to myself in case I do not get the property, then I can save it back to my bank. If I do get the property, then just endorse the check.

Anyone has real life experience?

In the same vein, shouldn't the escrow make sure that all the issues be cleared before closing?

As a buyer, should I be concerned about potential lien issues on a probate sale? Before they list the property, shouldn't those issues already be taken care of?

In general, what issues should I investigate?
