Are you selling the house for $60k or would that be the profit from the sale, net of paying the mortgage off?

I would avoid doing deals with any form of SO unless and until you put 2 rings on it.

Brandon Sounds like she may be bipolar or schizophrenic with all the back and forth. There may be substance abuse to boot, but she may need special housing that you don't provide.

I think with the new developments you may want to reconsider. I would think that as a part of your lease agreement you would have a clause that nullifies the agreement if you find falsified information. I would personally shut it down at this point. do it right or not at all. Also, what Joel said.

I think that's a nice welcome gift, especially of the new tenant isn't from the area. Gives them an incentive to get out & about.

 Leland, my intention is to provide a fun move-in perk. I remember the not too distant days when I was a renter, I always enjoyed the coupon books.

I would like to provide a coupon book, preferably for local businesses, to my renters upon move-in.

There is no "moral" factor as long as all parties involved enter into the transaction voluntarily and with congruent, veracious information. Try to make as much money as you can and don't think twice about it when you do, there is nothing wrong with doing well!

This may be one of those "gut" judgements, but when I think of criminal offenders, a married mother of 2 is not the profile on the top of my list. I would weigh the absence of this information with the Husbands records, and use your judgement about the character of the couple, based on your interactions. Seems like it should be alright. And if I may *gasp* stereotype, Hispanics usually have a deep family and religion oriented culture; that would further ease my mind about the criminal concerns. Best of luck to you!

My thoughts...your actions send messages about what is acceptable or not acceptable. If you fail to follow through with the agreed upon remedy/consequence of non-payment, you send the message to the tenant that they can get away with it in the future, and are setting yourself up for more headaches in the future. Be a stickler, it's for your own good. And more than likely, for the tenant's good as well.

George, no reason to file in Delaware. Corporations file there because Delaware has a specialized business court system, so businesses don't have to get in line behind someone trying to sue for alimony payments. Unless you do many B2B transactions, you should just file in the state in which you will be headquartered (hopefully that will be the most income tax advantageous state.)

There's a lot of justified sentiment among the BP forums that LLC is not necessary since it may create more work and expense than required for liability protection. My personal philosophy is that you cannot be too careful; I would rather a plaintiff be salivating over my scant business assets than my personal retirement account and residence.

In States like my home state, Georgia, the LL-Tenant law is LL favorable...so it would take gross negligence to pierce the corporate veil. In your state of California, I would imaine it more likely for a judge to disregard your incorporation and hold you liable. But my words are NOT LEGAL ADVICE. Just check with a local attorney.
