Thanks a lot Tim! I have a similar agreement like your "option repurchase agreement"; mine is called a release of contract agreement but its mainly used if I actually have a contract to buy it, not an option. I just need to figure out how to make it for the option. My release of contract basically says:

Seller agrees to pay to My Company, the total difference between _________________ and the new selling price to be determined in the new contract between __Sellers Name__
and any third party buyer introduced by My Company, in exchange for the release of all rights My Company possesses in the subject property located at: Address

Could you give me some feedback on this?

Forgot to ask this:

When you do get an option to purchase from an owner what kind of interest do you have in the property?

Is it equitable interest or something else?

Once your tenant buyer is ready to exercise their option what do you do from there?

Hey Bill thanks for the feedback.
Ive heard of offering the owner 1% every year I dont exercise the option then charge the tenant buyer 2-3% every year they do not exercise. The 1% to the buyer is obviously if you really want the deal otherwise I wouldn't mention it.

Here is what I'm thinking. I have a lease with an option to buy for say 5 years and the agreed price is 150k, i also get him to sign a release of contract / contract buyout. I find a tenant buyer and do a lease with him and an assignment of contract. In the assignment I make his effective date exactly 1 year and the price I change to 165k. When the sale is complete, my company collects the proceeds from the title closer.

My big question is: can you change the price on an assignment of contract or could that cause an issue? Can you even change the dates the option is valid; from me to the assignee?

Or would it be better to go with getting a lease with option to buy (separate forms) with the homeowner and then giving a lease with option to buy (separate forms) with your tenant buyer?

Thanks Bill! That's some good feedback. You had said that when you get a tenant buyer that it is good to do a lease agreement and under another agreement, assign your option. This sounds like a great way to do it! Obviously everyone would need to check with their own state laws or recommendations, but what could the title of the agreement state? Maybe something like: "Assignment/Option Agreement"

I do have 2 forms for the owner and 2 forms for the tenant buyer. I like the idea of just telling them that I have partnered up with the homeowner or just disclosing it in the paperwork.
Thanks a lot for all your reply's, they were much helpful and needed! I don't have a real estate license as of yet and I see the truth in what you said Herbster. Im pretty sure in the state of Virginia you have to be a licensed agent in order to be a property manager.

When you get a lease with an option to buy from a homeowner and then find a tenant/buyer, it's sounds a little weird when you bring out a lease and an option to buy contract. For one thing, I'm not even the owner; so shouldn't instead of giving them a lease to sign i should have them sign an "agreement to sublease" since I'm not the owner?? If the tenant buyer wants a title search before he/she takes the deal, it will show that the owner is somebody else. Hopefully I wrote this well and everybody can understand what I am asking!
