Hi Amy I’m from NYC and unfortunately your tenant is right. My mom has a two family home in Queens and I help her out with repairs and the tenants (her English is not that good). We ran into this situation this year. When we originally filed the eviction papers the laws didn’t change to 90 days notice yet. When the court date came up their court appointed free lawyer was able to ask for a dismissal since the new laws require 90 days. Luckily for my mom they found a place and moved out on November 1st. This was only the 2nd tenant in 25 years we ever had a problem with. The first one milked one year of free rent because the laws favor tenants so much that if a tenant says to a judge I can’t pay my bills or need 6 months to save money the judge will listen to them. I’d offer your tenant an agreement that she can live rent free for the next three months as long as she’s out of the apartment by this date. Like I said, NYS and NYC are so outrageously unfair to landlords and when you get a “professional” tenant you’ll have a hard time getting rid of them. All the best
