UPDATE! 

Received an email and text from yanyee this morning telling me he’s ready to sign the release today. I told him to contact my attorney. 

Also, @bill F, I will take your advice from here on out. I didn’t know where to turn when I ended up in this mess and I figured a room full of investors and realtors would be the perfect place to ask these questions. I thank BP and everyone that was here with me through this, the advise and guidance is truly appreciated. 

Just wish I could post pictures on here so y’all could see the mountain of incompetency this man is displaying.. 

Yeah, a NEW memorandum of contract filed a day after I text AND emailed him to release the original one. SMH.. 

UPDATE!

Demand letters went out March 11th 2019 to LLC the guy the agent/wife and the real estate broker. March 14th 2019 a NEW memo is now on the property saying " In witness whereof, buyer has duly executed this contract as of the 7th day of March 2019. This memo was notarized by a different notary, not his agent/wife.

I definitely did NOT sign a new Contract with this company. 

Filing suit tomorrow.

 NB Elite Realty is listed here on BP, but under two other folks who must be colleagues of your slimy agent.  I just sent them both colleague requests with links to this forum post.  They may then go to their managing broker to let her know that their colleague is damaging their reputation in the investor community.

 NB elite has over 200 listed agents if you search TREC. Another odd thing about NB try to give that listed number a call. Listen to the options then press any of them, none of them work.. you cannot simply call and talk to anyone. To get the brokers number I had to really search and it did me no good. It just goes to voice mail as if she just turned her phone off.

 Did you file a TREC complaint?

I can put something together that would advise BP how to pursue defending these claims, costs, timing, etc. The problem is that most claims won't be worth litigating, even pro bono.

 I haven’t filed anything yet, waiting on the demand letter to go out today  to see if we can get a response if we do and they lift it I will continue to close on my house only slightly delayed. If they don’t respond I will file the complaint to TREC. 

Thanks guys for your concern and I appreciate your offers but I went ahead and got a good real estate attorney and put together a demand letter it goes out to tomorrow I think these guys will definitely rethink the answer they gave me when I asked them to release that memo. I’ll keep y’all posted.

If this guy didn't put down EMD, didn't pay an option fee, then he didn't really have any consideration in the deal to begin with. Was he not required to do those things per terms of the contract?

The title company was capital title, the contract didn’t have an option or earnest. The buyer did not put one dollar towards the home.. only $16.00 to file the memo and cloud my title indefinitely. With the TBD close date it would have locked me in forever had my contingency not been in place.
